1. About These Terms

These Terms and Conditions ("Terms") set out the basis on which Wasiat Seri ("we", "us", "our"), a legal practice registered in Sabah, Malaysia, provides pension legal services to clients ("you", "your"). Our principal office is located at Jalan Gaya 38, 88000 Kota Kinabalu, Sabah.

By engaging our services, submitting an enquiry, or using our website at wasiatseri.club, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, please do not proceed with an engagement or use our website.

These Terms should be read together with our Privacy Policy and Cookie Policy.

2. Our Services

Wasiat Seri provides legal assistance in connection with pension and retirement matters in Malaysia. Our current service offerings are:

Retirement Review — RM 255

A structured review of your pension entitlements and contribution records, presented in clear and accessible terms to help you make informed decisions at your own pace.

Dispute Representation — RM 675

Representation for contested or delayed pension claims, including document preparation, correspondence, and appearances before relevant bodies on your behalf.

Ongoing Protection Arrangement — RM 1,590

A comprehensive service covering nominee documentation, records management, and scheduled reviews. Trusted family members may be included, and follow-up support is available as needed.

We may from time to time offer additional services or vary service scope by written agreement. Any such variations will be confirmed in writing before work commences.

3. Engaging Our Services

An engagement begins when we issue a written confirmation (by email or letter) and you indicate your acceptance, whether in writing or by proceeding to make payment. Until that confirmation is issued, no professional relationship or duty is created between us.

We reserve the right to decline any engagement at our discretion, including where we identify a conflict of interest or where the matter falls outside our area of practice.

We will perform services with reasonable care and skill, in accordance with the standards expected of a Malaysian legal practice and consistent with the rules of the Bar Council Malaysia (Sabah Bar) where applicable.

4. Fees and Payment

Our fees are as listed in Section 2 above, or as otherwise set out in your engagement confirmation. All fees are stated in Malaysian Ringgit (RM) and are inclusive of applicable taxes unless otherwise noted.

Payment terms and accepted methods will be communicated at the time of engagement. We may require a deposit or full payment in advance before work begins, depending on the service requested.

If you have any concern about fees or payment, please raise this with us before confirming your engagement. We will make every effort to discuss the matter with you in a manner that is straightforward and unhurried.

Unpaid fees may be subject to recovery action in accordance with Malaysian law. In such cases, reasonable costs of recovery may also be sought.

5. Cancellation and Refunds

If you wish to cancel an engagement before work has commenced, please notify us in writing as soon as possible. In such cases, any deposit paid may be refunded, less any reasonable administrative costs already incurred.

Where work has commenced, fees for the portion of work completed will be applicable and will be communicated to you clearly. We aim to handle all cancellation matters with consideration and fairness.

Refunds, where applicable, will be processed within a reasonable period using the original payment method where practicable.

6. Client Responsibilities

You agree to provide us with accurate, complete, and timely information and documentation as reasonably required for us to carry out our work. Providing false or misleading information may affect the outcome of your matter and may result in the termination of the engagement without refund.

You are responsible for keeping us informed of any changes in your circumstances that may be relevant to your matter, including changes to your contact details, employment status, or family arrangements.

Where we require your authority to correspond or act on your behalf with pension bodies or government agencies, you agree to provide that authority promptly in the form we reasonably require.

7. Confidentiality

All information you share with us in connection with your engagement will be treated as confidential. We will not disclose your personal or matter-related information to third parties without your consent, except as required by law, by court order, or to the extent necessary to deliver the service you have engaged us for (for example, corresponding with a pension authority on your behalf).

Our obligations of confidentiality are consistent with our duties under the Legal Profession Act 1976 and applicable rules of professional conduct.

8. Personal Data

We handle all personal data in accordance with the Personal Data Protection Act 2010 (PDPA 2010) of Malaysia. For a full explanation of how we collect, use, store, and protect your personal data, please refer to our Privacy Policy.

By engaging our services, you consent to the handling of your personal data as described in the Privacy Policy.

9. Limitation of Liability

Our services are delivered with care and professionalism. However, the outcome of any pension matter may depend on factors beyond our control, including decisions made by pension bodies, courts, or regulatory authorities. We do not make representations about outcomes, and nothing in our communications should be taken as an assurance of a particular result.

To the extent permitted by Malaysian law, our total liability to you in connection with any engagement shall not exceed the fee paid for the specific service to which the claim relates.

We are not liable for any indirect, consequential, or incidental losses arising from your use of our services or from matters outside our direct control.

10. Intellectual Property

All content on our website — including text, design, and layout — is the property of Wasiat Seri and may not be reproduced or distributed without our written permission. Documents we prepare for you as part of your engagement are provided for your personal use in connection with your matter only.

11. Website Use
